Vibebly is a discovery layer, not the games themselves. These terms keep that boundary clear and set fair rules for sharing work.
The short explanation in this header is only a guide. The numbered sections below are the terms that govern the Service.
Agreement and eligibility
These Terms govern your access to and use of Vibebly, including its catalogue, website, API, and game-submission tools (together, the “Service”). By using the Service, or by submitting a listing, you agree to these Terms and our Privacy Policy.
You must be able to enter into a binding agreement under the law that applies to you. If you use the Service for an organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use or submit content to the Service.
What Vibebly is
Vibebly is an independent discovery catalogue for browser-playable games. We organise metadata and link players to games hosted and operated by their makers or other third parties. Unless a listing says otherwise, we do not develop, publish, host, sell, license, operate, or support the listed game.
A listing, verification badge, category, engagement signal, or editorial placement is a catalogue decision, not an endorsement, guarantee, certification, or statement that a game is lawful, safe, secure, accurate, available, or suitable for you.
External games and links
Games and creator profiles open on third-party websites. Those sites have their own terms, privacy practices, security, content, age requirements, and technical requirements. We do not control them and are not responsible for their content, availability, conduct, transactions, downloads, advertising, tracking, or changes.
Follow external links at your own discretion. Use current browser and device security, review the destination before sharing information or installing anything, and contact the third-party operator about problems with its game or site.
Your submissions and licence
You keep ownership of content you submit. You confirm that the listing is accurate, that you are authorised to submit it, and that the game, text, names, links, artwork, and other material do not violate another person’s rights or applicable law.
You grant Vibebly a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, crop, display, communicate, and promote the submitted listing and its associated material solely to operate, improve, and promote the Service. This licence allows us to create catalogue cards and social previews and to use service providers for those purposes. It ends when the listing is removed, except for reasonable backups and promotional material already distributed.
Do not submit private information about someone else without their authority. Submitting a game does not create a public listing or promise publication. A submission remains non-public while we review it. If we approve it, its listing information may become public and searchable. Pending and approved submissions may disappear on a server restart while the Service uses temporary MVP storage.
Acceptable use
You may not use the Service to submit, link to, or distribute:
- illegal content or content that facilitates unlawful activity;
- malware, phishing, credential theft, deceptive redirects, exploits, or code intended to harm users, devices, or networks;
- material that infringes intellectual property, privacy, publicity, confidentiality, or other rights;
- sexual exploitation, credible threats, targeted harassment, hateful abuse, or content that presents an unreasonable safety risk; or
- spam, impersonation, manipulated engagement, misleading metadata, or repeated duplicate listings.
You must not probe, overload, scrape at a disruptive rate, bypass technical limits, interfere with the Service, or use it to access systems or data without permission.
Curation, moderation, and reports
We decide whether and how a submission appears in the catalogue. To the maximum extent permitted by law, we may verify, approve, reject, edit, recategorise, suspend, limit the visibility of, or remove any submission or listing at any time, with or without advance notice, including for editorial quality, safety, accuracy, legal compliance, inactivity, technical risk, or consistency with these Terms. We do not promise to publish a submission or keep an approved listing available.
We are not obliged to continuously monitor every approved external game or creator page. Where applicable law requires it, we will give the affected submitter a reason for a moderation decision and information about available review options using contact information reasonably available to us.
To report illegal, infringing, unsafe, or misleading content, email legal@vibebly.com with the listing URL, a clear explanation, the right or law involved, supporting evidence, and a way to contact you. We may ask for more information and will review sufficiently specific notices in good faith.
Intellectual property
The Service’s software, layout, catalogue presentation, and Vibebly names and marks are owned by or licensed to the operator and are protected by applicable law. These Terms do not transfer those rights to you. Game names, artwork, screenshots, code, and third-party marks remain the property of their respective owners.
You may link to public catalogue pages and use the Service normally. You may not imply endorsement, remove ownership notices, reproduce a substantial part of the catalogue, or use Vibebly branding in a way likely to confuse people without permission.
Availability and changes
The Service is an early MVP. Features, categories, rankings, URLs, storage, and availability may change, fail, or be withdrawn. We may suspend or discontinue all or part of the Service and may impose reasonable technical limits. We do not promise to retain submissions or provide backups, support, notice, or uninterrupted access.
You are responsible for keeping your own copies of anything you submit and for checking that a destination remains accurate and safe.
Disclaimers
To the maximum extent permitted by law, the Service and all listings are provided “as is” and “as available.” We disclaim express and implied warranties, including accuracy, availability, security, fitness for a particular purpose, satisfactory quality, non-infringement, and that defects will be corrected.
We do not warrant that an external game will work, be free of harmful material, preserve progress, be appropriate for a particular age, or match its listing. Nothing in these Terms limits a warranty or remedy that the law does not allow us to exclude.
Limits on liability
To the maximum extent permitted by law, Vibebly and its operator, contributors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profits, revenue, business, goodwill, data, progress, or opportunities arising from the Service, a listing, user content, or an external website or game.
Where liability may lawfully be limited, our total aggregate liability connected with the Service will not exceed the greater of EUR 100 and the amount you paid us for the Service in the 12 months before the event giving rise to the claim. The Service is currently free. These limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or mandatory consumer right that cannot lawfully be limited.
Business users
If you use the Service in a business or professional capacity, you will defend and indemnify the operator against third-party claims, damages, and reasonable costs resulting from your submission, your breach of these Terms, or your infringement of another person’s rights, to the extent permitted by law. This paragraph does not apply to consumers acting wholly outside their trade or profession.
Governing law and disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you habitually live, and disputes may be brought in any court that applicable consumer law permits.
Before filing a claim, please email legal@vibebly.com and allow a reasonable opportunity to resolve the issue informally. If one part of these Terms is unenforceable, the remaining parts continue to apply. A delay in enforcing a right is not a waiver of that right.
Changes and contact
We may update these Terms as the Service or law changes. The effective date above identifies the current version. Material changes will be presented reasonably before they take effect where required. Your continued use after an update takes effect means the updated Terms apply to later use.
